Children Are Vulnerable to Lead Poisoning

Children living in older apartments are quire vulnerable to becoming lead poisoned as a result of peeling and cracking paint and dust in their apartments. This is especially true in older buildings, where the paint often contains lead, and its condition is poor. Toddlers frequently put paint chips in their mouths, or touch and breathe lead dust.

Usually, a parent finds out a child is lead poisoned as a result of a blood test taken by the child's doctor. A child should be taken to the doctor if there are any signs of lead paint poisoning: loss of appetite with weight loss, stomachache, nausea and vomiting; headaches; trouble sleeping; irritability and nervousness; behavioral changes including hyperactivity, inattention and aggressiveness.

When a child has a high level of lead in the blood, it must then be determined if there is lead paint in the residence. This is usually determined by the local health department. If lead is found by the health department, then violations are issued to the landlord. Lead paint in the dwelling place is, by far, the most likely source of lead poisoning for a young child.

Consequences of Lead Poisoning

Lead poisoning can cause serious problems to a child, including learning disabilities and behavioral problems. The parent of a child diagnosed with an elevated blood lead level should immediately contact Trolman, Glaser & Lichtman. We can take the necessary steps to investigate the situation, and determine the most appropriate manner to proceed.

Often, we will send an independent company into the apartment to test for the presence of lead paint. Once it has been established that there is lead paint in the apartment and the child has a sufficiently height blood lead level, we bring a lawsuit against the owner of the building.
